Los estándares en la jurisprudencia
de la Corte Interamericana de
Derechos Humanos

Resumen:
Los estándares que la Corte Interamericana de Derechos Humanos ha venido es-
tableciendo a través de su jurisprudencia se han constituido como criterios de va-
lidez de los ordenamientos jurídicos de los países que suscribieron la Convención
Americana sobre Derechos Humanos, así como criterios de interpretación para los
respectivos jueces nacionales, con el objetivo de proteger los derechos establecidos
por dicho tratado internacional; constituyéndose, además, como fuente de creación
del Derecho Internacional de los Derechos Humanos.
En el presente artículo, el autor desarrolla los referidos estándares establecidos por
la Corte IDH, sean estos interpretativos o normativos, o se hayan constituido como
precedentes en el Sistema Interamericano de Derechos Humanos, tratando, asimis-
mo, el valor que han venido teniendo los mismos en función de los efectos de las
sentencias de la Corte IDH.

Abstract:

its jurisprudence have been constituted as criteria of validity of the legal systems in the
countries that have signed the American Convention of Human Rights, as well as cri-
teria of interpretation for the national judges in each country, in order to protect the

rights established by said international treaty. Being also a source of creation of the
International Law of Human Rights.
In this article, the author develops the standards established by the I/A Court H. R.,
whether these are interpretative or normative, or had become precedents in the Inter-
American System of Human Rights, also talking about the value of those standards
depending on the eects of the I/A Court H. R. sentences.
