Nuestro incipiente “activismo dialógico”:
las sentencias estructurales del
Tribunal Constitucional

Resumen:
Una nueva agenda de temas se presenta hoy a la justicia constitucional: se trata de
los problemas estructurales de violación de derechos, generados por situaciones de
bloqueo institucional, cuya reparación exige la actuación conjunta de autoridades
y sociedad civil, bajo supervisión de las cortes. El presente trabajo sugiere que ese
modelo “dialógico” puede encontrar importantes límites al desarrollarse bajo los
moldes de un constitucionalismo “fuerte” o de corte individual, lo cual explica el
estado aún incipiente de las sentencias estructurales del Tribunal Constitucional
perua no.

Abstract:
A new agenda of issues is presented today to constitutional justice: these are the struc-
tural problems of violation of rights, generated by situations of institutional blockade,
whose reparation demands the joint action of authorities and civil society, under the
supervision of the courts. e present work suggests that this “dialogic” model can nd
important limits when developing under the mold of a “strong” constitutionalism or
individual cut, which explains the still incipient state of the structural sentences of the
peruvian constitutional court.
