La ciudadanía demanda una justicia eficaz, célere e inclusiva
constituyendo los mecanismos alternati vos de solución de
controversias (conciliación, mediación, arbitraje, negociación)
medios que permiten la solución de conflictos de manera
alte rnativa al Pode r Judic ial y q ue los E stados vien en
promoviendo dadas sus ventajas y por ser la administración de
justicia un servicio que demanda la población el cual debe
brindarse de manera eficiente. Las Tecnologías de Información y
Comunicación (TIC), que se aplican en todos los ámbitos de la
actividad humana, son herramientas que también contribuyen de
manera más idónea al logro de una pronta justicia como viene
ocurriendo en Europa y Estados Unidos. El Perú cuenta con una
nueva Ley de Arbitr aje y promueve el Arbitraje Po pular,
asimismo, ha regulado el Arbitraje de Consumo en las relaciones
proveedores-consumidores estableciendo el uso de las TIC para
la notificación de las distintas actuaciones del procedimiento
arbitral. Es necesario promover el uso de las TIC, que han
trascendido fronteras y permite comunicaciones distantes en los
mecanismos alternativos de solución de conflictos, por los
resultados eficaces que se vienen dando en la solución de
controversias permitiendo una pronta justicia, que demanda la
población y que los Estados tiene la obligación de garantizar. El
Perú cuenta con las herramientas tecnológicas necesarias para
una mejor implementación de las TIC en los mecanismos
alternativos de solución de conflictos que regula, lo que

The article develops the antecedents of the Legislative Decree N ° 1071 that regulates the
new Law of Arbitration, its most outstanding aspects; likewise, the precedents of the TC in
matters of arbitration, the alternative means of conflict resolution and ICT, the application of
arbitra tion in technologica l matters, as wel l as co nsumer arb itration a nd ICT.

El artículo desarrolla los antecedentes del Decreto Legislativo N° 1071 que regula la nueva
Ley de Arbitraje, sus aspectos más resaltantes; asimismo, los precedentes del TC en materia
de arbitraje, los medios alternativos de solución de conflictos y las TIC, la aplicación del
arbitraje en materia tecnológica, así como el arbitraje de consumo y las TIC.
ABSTRACT
The citizen demands eective, inclusive and inclusive justice by establishing alternative
mechanisms for the settlement of disputes (conciliation, mediation, arbitration, negotiation)
means that allow the solution of conflicts in an alternative way to the Judiciary and that the
States are promoting given their advantages and because the administration of justice is a
service demanded by the population, which must be provided eciently. ICT, which is
applied in all areas of human activity, are tools that also contribute in a more ideal way to the
achievement of an early justice as it has been happening in Europe and the United States.
Peru has a new Arbitration Law and promotes Popular Arbitration, and it has regulated
Consumer Arbitration in supplier-consumer relations, establishing the use of ICT for the
notification of the dierent proceedings of the arbitration procedure. It is necessary to
promote the use of ICTs, which have transcended borders and allow distant communications
in alternative dispute resolution mechanisms, for the eective results that have been given in
the resolution of disputes, allowing for prompt justice, demanded by the population and
States have an obligation to guarantee. Peru has the necessary technological tools for a better
implementation of ICT in the alternative dispute resolution mechanisms it regulates, which
should be evaluated, considering the positive experiences of other countries.
