ANALISIS DEL CASO YYY EN LA COMISION DE DELITO EN
ESTADO DE EBRIEDAD DESDE LA CRIMINOLOGIA CLINICA
En el presente artículo, a través del expediente analizado, el cual trata
sobre el delito de conducción en estado de ebriedad, se explican los
factores biopsicosociales que intervinieron en la rehabilitación de una
persona, y que tuvieron injerencia antes del delito.
Se realiza una especie de combinación entre el libro de Luis Rodríguez
Manzanera, titulado «criminología» capitulo XVIII (la dirección
clínica), tomado junto al expediente como ejes principales del artículo.
Presentamos un marco teórico basado en el libro, seguido de la
descripción del caso concreto.
Respecto al factor biológico interviniente en la criminología, tenemos
que no queda plasmado de manera alguna en el expediente, el factor
social influyente anterior a la comisión del delito y durante la estadía
en el establecimiento penitenciario del interno, queda analizado en el
informe social, y el factor psicológico de igual manera que el sociólogo
queda establecido en el informe psicológico, aunque no a profundidad.
El análisis de la criminología clínica es realizado a través de un proceso
que pretende explicar los factores internos y externos que influyen en
la comisión de un delito y la conducta de un delincuente. En la
evaluación a realizarse se toma en cuenta los rasgos de personalidad,
comportamiento, entorno social, entorno familiar, entorno cultural.
Principalmente porque se debe observar al sujeto como un ente que
suma, un aspecto biológico, psicológico, sociológico, es decir como
una totalidad, pues todos ellos influyen en su conducta habitual.

ANALYSIS OF THE YYY CASE IN THE COMMISSION OF
CRIME IN THE STATE OF DRINK SINCE OF CLINICAL
CRIMINOLOGY
In this article, through the file analyzed, which deals with the offense
of driving while intoxicated, the biopsychosocial factors that intervene
in the rehabilitation of a person, and that had interference before the
crime, are explained.
A kind of combination is made between the book by Luis Rodríguez
Manzanera, entitled «criminology» chapter XVIII (the clinical
direction), taken together with the file as main axes of the article. We
present a theoretical framework based on the book, followed by the
description of the specific case.
Regarding the biological factor intervening in criminology, we have
not been reflected in any way in the file, the influential social factor
prior to the commission of the crime and during the stay in the
penitentiary establishment of the inmate, is analyzed in the social
report, and the psychological factor in the same way that the sociologist
is established in the psychological report, although not in depth.
The analysis of clinical criminology is conducted through a process
that aims to explain the internal and external factors that influence
the commission of a crime and the behavior of an offender. In the
evaluation to be carried out, personality traits, behavior, social
environment, family environment, cultural environment are taken
into account. Mainly because the subject must be observed as a being
that adds up, a biological, psychological, sociological aspect, that is, as
a totality, since all of them influence their habitual behavior.
