Resumen:
la potestad del empleador para regular el tiempo que el trabajador está a su
disposición y, por otro, como derechos básicos y elementales del trabajador
para que pueda conciliar el trabajo con su vida familiar. Es así que en el
jornada y horario de trabajo, derechos reconocidos en los convenios de la
Organización I nternacional del Trabajo y en nuestra nor mativa constitucional y
legal, abordando, t ambién, las exclusiones a las misma s, su determinación, las
jornadas atípicas , el trabajo en sobretiempo y el tr abajo nocturno. Sin duda, un
artículo de lect ura obligatoria para tod o aquel interesado en el Dere cho Laboral.

Abstract: Work days and work ing hours are established, on one hand, by t he
authority of emp loyers to establish the hours that wor kers are at their disposal
and, on the other, by the basic and el emental rights of workers to enable th em
to harmonize their wo rk with their family lives. In t his article, the author pr ovides
recognized in the conventions of the International Labor Organization and in
Peruvian constitutional and labor law. The discussion also includes: omissions
that exist in these nor ms; the manner in which these nor ms were decided upon;
and issues such as at ypical work days, overtime, and ni ght working hours. The
analysis provided is o bligatory reading for everyon e interested in Labor Law.
