The Facts.—Leonidas Rivera Calmet, Representative to Congress for the Province of Lima and publisher of the weekly, Buen Humor, was charged with publishing an article offensive to the President of Argentina and Sra Eva Duarte de Perón and thereby endangering the amicable relations of Peru with a foreign Government, an offence recognized in the Penal Code. While Rivera admitted fault in permitting publication of the article, and apologies were exchanged, he was tried, and sentenced to four months' imprisonment and the payment of fines.

On appeal,

Held: that the judgment under appeal must be affirmed. The Supreme Court, in sustaining the judgment under appeal, found that while there was a difference between Article 298 of the Penal Code, which concerns attempts to bring about a change in foreign relations by violence, and Article 299, which concerns hostile acts that may endanger foreign relations, “the concept of ‘danger’ (peligro) involves at the same time the concept of ‘risk’ (riesgo) or potential danger, which is not necessarily limited to a material act of aggression but may comprehend peril arising through the medium of the press or publications”.
