Extradition — Conditions of — Terms of Treaty — Maximum Penalty.

The Facts.—A Peruvian indicted in Arequipa (Peru) for fraudulent insolvency, fled to Argentina. The approval of his extradition was sought from the Peruvian Supreme Court in accordance with Peruvian law (Code of Penal Procedure, 1940, Article 347). The maximum penalty for the offence charged, according to the Peruvian Penal Code of 1924, Article 253, was one year's imprisonment.

Held: that extradition should not be granted. According to the Treaty of Montevideo2 of 1889 in force between Peru

and Argentina, extradition is allowed only when the accused is charged with a penal infraction which is subject to a penalty of not less than two years' imprisonment. It appears that one year in prison is the maximum which corresponds to the infraction in this case.
