INTRODUCCIÓN
La protección de los derechos humanos y del medio
ambiente siempre ha sido íntimamente imbricada, pero esta
relación ha sido destacada especialmente por la creciente
preocupación de la protección ambiental, vinculada a la ex-
pansión sin control del desarrollo sostenible. Hoy en día, un
estudio completo sobre el derecho del medio ambiente implica
indudablemente una referencia a los derechos humanos. La
práctica demuestra cada vez más que las problemáticas de estos
dos ámbitos están interconectadas18.

Un estudio integrado de los derechos humanos y del dere-
cho ambiental puede realizarse siguiendo al menos dos métodos.
En primer lugar, es posible interrogarse sobre la existencia
de un derecho humano ambiental, esto es, el derecho del ser
humano a vivir en un medio ambiente sano. Si esa preocu-
pación no existía en los primeros instrumentos relativos a los
derechos humanos19, ella fui incluida posteriormente en algunos
tratados y Constituciones nacionales20. Por ejemplo, el artículo
24 de la Carta Africana sobre Derechos del Hombre y de los
Pueblos dispone: “Todos los pueblos tienen derecho a un medio
ambiente general satisfactorio, propicio para su desarrollo”21.
Un protocolo sobre los derechos de las mujeres en África fue
anexado a esa carta en el 2003 y los artículos 18 y 19 afirman
