El daño en el campo de la responsabilidad civil se enfoca dentro del contexto del
artículo 1969º del Código civil, el cual señala que “Aquel que por dolo o culpa
causa un daño a otro está obligado a indemnizarlo (…)”. En ese sentido, la fase
más importante y compleja a la vez, es la labor probatoria, partiendo de la siguiente
premisa: ¿Cómo probar la existencia del daño?, resuelta esta tarea, queda por
resolver la fase de valoración y cuantificación del daño, en las cuales se analizaran
no solo las circunstancias del caso en concreto, sino también, a los elementos de la
misma.

In The damage in the field of civil liability is focused within the context of Article
1969º of the Civil Code, which states that "He who by intent or fault causes harm to
another is obliged to compensate (...)." In this sense, the most important and
complex phase at the same time, is the probative work, starting from the following
premise: How to prove the existence of damage? Once this task is solved, the phase
of assessment and quantification of the damage remains to be resolved, which will
analyze not only the circumstances of the case in particular, but also, the elements
of it.
